Terms & Conditions - Desk Warehouse

1. Introduction

These terms and conditions (the "Terms") set out the basis on which The Desk Warehouse Limited ("we", "us", "our") sells goods to you via our websites deskwarehouse.co.uk and deskwarehouse.ie (collectively, the "Site").

By placing an order on either of our Sites, you agree to be bound by these Terms.

2. Basis of Sale

2.1. Order Process: Our website guides you through the steps to place an order. You are responsible for ensuring that your order details (including quantity and specifications) are accurate.
2.2. Order Acknowledgement: After you place an order, you will receive an email acknowledging that we have received it. This does not mean that your order has been accepted.
2.3. Acceptance: Acceptance of your order and the formation of the contract between us will only take place when we send you an email confirming that the goods have been dispatched ("Dispatch Confirmation"). We reserve the right to reject any order for any reason prior to dispatch (e.g., stock unavailability or pricing errors).

3. Product Descriptions & Images

3.1. Accuracy: We take reasonable care to ensure that all details, descriptions, and prices of products are correct. However, we do not warrant that product descriptions or other content are error-free.
3.2. Images: The images of the products on our site are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer's display of the colours accurately reflects the colour of the products. Your products may vary slightly from those images.
3.3. Measurements: All measurements and dimensions are approximate. It is your responsibility to ensure the furniture will fit into your premises and through any doors, lifts, or staircases.

4. Price and Payment

4.1. Pricing: The prices of the products will be as quoted on the respective Site: deskwarehouse.co.uk: Prices are in GBP (£). deskwarehouse.ie: Prices are in Euro (€).
4.2. VAT: Prices include VAT at the applicable rate (unless otherwise stated) but exclude delivery costs, which will be added to the total amount due via the checkout process.
4.3. Payment: We accept payment via major credit and debit cards through our secure payment processor, Stripe. Payment is taken at the time of order in the currency of the Site you are purchasing from.
4.4. Pricing Errors: If we discover an error in the price of the products you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming the order at the correct price or cancelling it.

5. Delivery

5.1. Estimates: Delivery dates are estimates only and are not guaranteed. We shall not be liable for any direct or indirect loss or damage caused by a delay in delivery.
5.2. Delivery Location:
- Northern Ireland: For addresses within Northern Ireland, we aim to deliver items to your room of choice, provided there is safe and clear access. Please note: If the room is on an upper floor without a suitable lift, delivery will be to the ground floor only unless arranged with us in advance.
- Rest of UK & Republic of Ireland: Standard delivery is to the ground floor / kerbside only. Our couriers are not insured to carry goods up stairs or into specific rooms.
5.3. Access: You must ensure that there is adequate access for the delivery vehicle and that the goods can fit into your premises. If delivery fails because of access issues or because no one is available to accept the goods, we reserve the right to charge a re-delivery fee.
5.4. Risk: Risk of loss and damage of products passes to you on the date when the products are delivered.

6. Returns and Refunds

6.1. Returns are governed by our Returns Policy, which is incorporated into these Terms by reference.
6.2. Installed Goods: You acknowledge that if furniture has been delivered and installed (whether by our team or assembled by you), it is no longer considered "new". Consequently, any such return accepted by us will be subject to a restocking fee of up to 30% to cover the loss in value and dismantling costs.
6.3. Return Costs: Unless the item is faulty, you are responsible for the cost of returning the goods to our Belfast warehouse.

7. Warranties and Liability

7.1. Consumer Rights: If you are purchasing as a consumer, you have certain legal rights in relation to products that are faulty or not as described. Nothing in these Terms will affect these legal rights.
7.2. Business Customers: If you are purchasing for business purposes:
- We supply the products for internal use by your business, and you agree not to re-sell them.
- Our total liability to you for all losses arising under or in connection with the contract shall be limited to the total price of the products paid.
- We shall not be liable for any indirect or consequential loss, including loss of profit, loss of business, or depletion of goodwill.
7.3. Events Outside Our Control: We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by events outside our reasonable control (Force Majeure), including but not limited to strikes, industrial action, or failure of transport networks.

We will only use your personal information as set out in our Privacy Policy.

9. Governing Law

These Terms are governed by Northern Ireland law. Any dispute or claim arising out of or in connection with a contract between us shall be subject to the exclusive jurisdiction of the courts of Northern Ireland.
